Terms of service
Effective 7 September 2026Last updated 28 September 2026
Before publishing: add the contact email address, and have a lawyer review the liability and termination sections. Those are the clauses that matter when something goes wrong.
Ontario law, monthly billing in advance and a 3-month liability cap are drafted defaults. Ontario is inferred from the Hamilton focus of the business and must be confirmed — governing law should match where the business is actually established, not where its customers are.
Cancellation follows the common practice for monthly online services: cancel at any time, no notice period, no partial-month refund. That also sits with the direction of Ontario’s Consumer Protection Act, 2023, which requires an ongoing right to cancel and forbids putting obstacles in the way. Those rules are written for consumers rather than businesses, and our customers are businesses, so a lawyer should confirm how much of it applies here rather than assuming it does not.
These terms cover this website and the Contractor Ops service provided by Contractor Ops. By using either, you agree to them. If you are agreeing for a business, you confirm you are allowed to do so on its behalf.
1. Definitions
Capitalised words have the meanings given here wherever they appear in these terms.
- Service means the Contractor Ops managed service described in section 2, together with this website.
- Customer Data means information about your business and about your customers that you give us, or that we collect while running the Service for you.
- AI Draft means text prepared with the assistance of an automated model and held for review. An AI Draft is not a message that has been sent.
- Fees means the amounts set out in the written scope agreed before work starts.
- we, us and our mean Contractor Ops. You means the business agreeing to these terms.
2. What the service is
Contractor Ops is a managed service. We help create demand and we operate front-office work — responding to enquiries, booking, following up on quotes and invoices, and requesting reviews — supported by our software.
You are buying an ongoing service, not a licence to a product. You do not receive a copy of the software or this website, and access ends when the service does.
3. A person stays responsible
Where the Service uses AI, it produces an AI Draft. A person reviews and approves anything before it reaches your customer. Prices, emergencies, complaints, technical diagnosis and changes to your schedule always go to a person.
We do not promise that an AI Draft is free of error. That is precisely why approval sits with a person, and why you should treat any draft as a suggestion rather than a decision.
If automated phone service is included in your written scope, callers are told they are speaking with an automated service. It may answer approved routine questions, gather confirmed callback details, request an appointment, or try to connect the caller to a person. It does not diagnose technical work, promise a price, or replace emergency services. A transfer or callback ticket does not guarantee that a person is immediately available.
4. What we ask of you
- Give us accurate information about your business and your services.
- Only give us customer contact details you are lawfully allowed to share and to contact.
- Review and approve what we prepare, within a reasonable time. Work can stall while it waits for you.
- Keep your own accounts secure and tell us promptly if access is compromised.
- Do not use the service to send unlawful, misleading or unsolicited messages.
Anti-spam law
If we send messages on your behalf, you confirm you have the consent the law requires — in Canada, under CASL. You remain responsible for the lawfulness of contacting your own customers. If you ask us to send something we believe is unlawful, we will refuse.
5. Your information stays yours
Customer Data remains yours. We use it only to run the Service for you. Our privacy policy explains the detail.
On request when the service ends, we will provide a copy of your records in a machine-readable format and then delete them, subject to anything we are legally required to keep.
6. Third-party services
The service connects to tools you already use — email, calendars, booking, messaging, accounting. Those are governed by their own terms. We are not responsible when a third-party service fails, changes, or withdraws access, though we will tell you when it affects you.
7. Fees
Fees, what is included, and the payment schedule are set out in the written scope we agree before work starts. Fees are payable monthly in advance. We will give 30 days’ notice of any change, and a change never applies to a month you have already paid for.
Your scope states the volume included each month, such as the number of calls, messages or conversations we handle. If you go over it we will tell you and agree what happens next. We will not bill you for overage you did not agree to in advance.
8. Fair use of the service
The service is for your own business communications with your own customers. You may not use it to send unsolicited bulk messages, to contact people who have withdrawn consent, to impersonate someone, or for anything unlawful.
We may pause a specific channel, or the whole service, if we believe it is being used that way, or if a provider we depend on requires it. We will tell you why, and we will restore it once the cause is resolved.
9. Ending the service
You can cancel at any time. Email us and we will act on it. There is no notice period, no cancellation fee, and no form you have to find. Cancelling takes effect at the end of the month you have already paid for, and you keep the service until then.
We do not refund part of a month. A month you have paid for runs to its end whether you use it or not. If we have charged you in error, or billed you after you cancelled, we refund that in full.
We may end the service with 30 days’ notice, or immediately if it is being used unlawfully or fees are seriously overdue. On termination you can request your data as described above.
10. What we do not promise
We do not guarantee a particular number of leads, bookings, or any level of revenue. Marketing results depend on many things outside our control. Nothing on this website is a promise of a specific outcome.
We aim to keep the service available but do not guarantee uninterrupted operation. Maintenance, provider outages and events outside our control will sometimes interrupt it.
This is an online service. It runs continuously rather than during set opening hours, and we do not publish staffed hours. That also means we do not promise a response time for a person to reach you. When something needs a human decision it waits for one, and urgent matters should not depend on us.
11. Limits of liability
To the extent the law allows, neither party is liable for indirect or consequential loss, including lost profits or lost business. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim arose.
Nothing here limits liability that cannot lawfully be limited.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have exclusive jurisdiction.
13. Changes
We may update these terms. Material changes will be notified in advance, and continuing to use the service after they take effect means you accept them.
